NY Comptroller, DiNapoli now promises safe returns of 7.5%, when the NY pension plan for the prior ten years, when higher safe returns were possible, never earned over 4%. DiNapoli had claimed the NY Pension Funds were getting 8% expected returns for his first three and one half years in office.
Now look at Greece, where, "Greek bond yields, a measure of investor confidence in the country's finances, rose on Monday, with the rate on 10-year paper up to 11.280 percent from 11.184 percent on Friday."
and "The Greek economy shrank 4.5 percent in the last 12 months, official data showed on Friday. Gross domestic product contracted by 1.1 percent in the third quarter."
Now back to NY, where "The Federal Reserve Bank of New York reported its manufacturing activity index dropped to minus -11.1 points in November, from a positive +15.7 points in the previous month. The Empire State Manufacturing Survey index is considered a bellwether of the manufacturing sector which has been a key strength in the economic recovery. It was the first time the index fell below zero since July 2009, the month after the worst recession in decades was officially declared over. The sharp 27-point decline surprised analysts, who had forecast on average a slip to a positive 11.7-point reading. The new orders index plummeted to minus 24.4 points, from positive 12.9 points in October."
Now, tax receipts are down (24.4 points) from manufacturing (a bellweather) of non-government sources; there's a 420% increase in the taxpayer share of pension costs; NY's borrowing costs for next year which earlier were predicted at $5.6 Billion with the TIC (True Interest Cost) of recent offering: 3.357% will quickly move up to paying the Greek rate of 11.28%. Thus NY's borrowing costs will move up from $5.6 Billion to $18.8 Billion. ($5.6 Billion times 11.28% divided by 3.357% = $18.8 Billion)

Compared to California's Pension liability: $454 billion; Percent funded: 86.89%; Employees in Pension Plans: 1,995,169 But, Government Accounting Rules allow state pension plans to calculate their obligations using an assumed long-term yield of 8%.
Second, the law of economic reality, which like law of gravity cannot be ignored:

Andrew Cuomo Meets "The Ghost Of NY Yet To Come"; Was It Thomas Dewey?
Last night, Andrew was visited by the Ghost of NY Yet To Come.
Last night, a Ghostly figure, who looked like a groom figurine with a mustache on a wedding cake, appeared to Andrew and showed him 2011 Newspaper clippings where all the NY Budget predictions in a prior post had come true. Andrew then was carried to Seoul, South Korea, where he read the next day's headline in Financial Times, "China tees up G20 showdown with US." Andrew heard China's Cui Tiankai say, "that the US plan for limiting current account surpluses and deficits to 4 per cent of gross domestic product harked back “to the days of planned economies”.
Now the Ghost of NY Yet To Come carried Andrew into many varied homes of rich and not-so-rich NYer's. Andrew saw each cringing at finding their tax- free NY municipal bonds had diminished in value because of the interest rate increase of 231% due to Obama/Federal Reserve printing money. He saw the calculations were written on all their walls, 100% divided by 231% = 43% and saw they were crying at the new 57% ( 100% -43% = 57%) lower value of their tax-free bonds. He saw all these angry tax-free bond holders packing up to leave NY, while cursing Andrew who destroyed their income protection. "A pox on Andrew and them all. Where will Andrew get any money when we leave," they snickered.
Then, another ghostly figure appeared. He heard that apparition say I'm the Ghost of Arnold of California Past. And grinning, the ghost picked from the mantle top a large vessel inscribed Trophy of Total Fiscal Failure and handed it to Andrew. The Ghost of Arnold of California Past then gave Andrew a Bill in the the ghost's name for $40 million dollars a day borrowed to pay unemployment insurance, and said to Andrew, "this too will haunt you."
The Ghost of Arnold of California laughingly said, "I had only $80 billion in General Obligation Debt and you had $120 billion and a whole lot less people to spread it among." The ghost kept laughing and said, "my State was described as the Lindsay Lohan of States, but yours will fare worse as the John Belushi of States."
Andrew turned to the Ghost of NY Yet To Come with his mustache and said, "you look familiar." The Ghost replied, "I was a former Governor and Prosecutor." Andrew asked, "why do I dread you so?" "I'm the harbinger of the your new tormentor, who will rise in my former role." And the Ghost of NY Yet To Come carried Andrew back to his bed passing over endless angry crowds screaming, "He's impoverished us." .
Andrew awoke sweating. A Pox? Was that Thomas Dewey? Was he just imagining that he saw pitchforks? Oh, no, there's the Trophy of Total Fiscal Failure.

1. Cuomo's same ole' M.O., this time around : Cuomo's Swamp's clarion trumpeted, "We're not going to buy our way out of these problems;"
and "I'm looking forward to working with the leadership of the Assembly. (these are the same Assembly Swamp vermin Cuomo promised to clean out)"
2. The same Cuomo M.O. in 2008, when Cuomo began as Attorney General: In 2008, Cuomo promised: "The Amnesty 'window' will be narrow;' Andrew's pretty serious about a real shake up, and he will not give state workers, including judges, more than 60 days to 'come clean.' The plan, dubbed 'CAP' (Cuomo's Amnesty Program)by AG lawyers, is said to specifically include all attorneys admitted to practice in New York, whether or not they are state employed. 'Heads will role once the Amnesty Program ends"
And as Cuomo's term as AG ends: the result is nothing was done.
3. The same ole' M.O. in the Hevesi corruption case: "Mr. Hevesi's conviction was the seventh and by far the most notable in a long-running investigation by state Attorney General Andrew Cuomo."
The result: no jail time or restitution for Hevesi and sons and minimal sentence for a political operative.
Now, listen to Governor-elect Cuomo's rhetoric that, "by immediately imposing a cap on state spending and freezing salaries of state public employees as part of a one-year emergency financial plan, committing to no increase in personal or corporate income taxes or sales taxes and imposing a local property tax cap." Meanwhile, Paterson's has projected a $9 billion deficit for the 2011-2012 fiscal year, which is grossly underestimated and Cuomo neglects to include Medicaid refunds NY State must pay back to the Federal Government. These Medicaid refunds just begin with $1.6 Billion required in just the small sample reported on this blog.
Will the new Republican House forgive and forget NY's unprosecuted Medicaid frauds and advance the another $1.6 billion for the same thieves to take again? Or is Cuomo expecting the tooth fairy to intervene?

NY Supreme Court Judge Lewis Stone said, “This case is, in this court’s opinion, one of the most important cases relating to corruption in government in the state of New York and perhaps one of the almost seminal cases involving that in the country. There are enormous considerations on this,”
And Wolf 1, Andrew Cuomo, said about the case, "probably the largest political corruption scandal in modern political history." Wolf 6, Hank Morris, faced "77-count indictment, including one charge that carries a penalty of up to 25 years."
But Wolf 1, Andrew Cuomo, allowed a plea down to which, "Morris would plead guilty to 'a minor charge' that carries a maximum sentence of 1 1/3 to 4 years."
The Daily News let the sheeple know after the election that, "there will be a jarring disconnect between his rhetoric before Election Day and the plea bargain that surfaced shortly after he won the race for governor."

Andrew Cuomo Hopes To Fool NY Sheeple About Wolf 2, Alan Hevesi, Going To Jail

1. "Approval from Mr. Cuomo not to prosecute his [Alan Hevesi's] two sons, Wolf 3 (Assemblyman Andrew Hevesi) and former state senator Wolf 4 (Daniel Hevesi)."
2. And then revealed through Carl Paladino, in Plattsburgh, yesterday, "Cuomo is recommending no jail time for Wolf 2 (Alan Hevesi)."
3. The fooled sheeple will be told after election of Cuomo's plea bargain recommendation "to give him probation." so that Wolf 2, (Alan Hevesi), won't go to jail.
Now look at restitution that resulted from Wolf 1 (Andrew Cuomo): "Markstone Capital agreed in February to repay $18 million in management fees to the Common Retirement Fund." and "Quadrangle agreed in April to pay $12 million to settle investigations by Mr. Cuomo and the Securities and Exchange Commission."
Was restitution obtained by Cuomo from the (Hevesi) Wolves 2, 3 and 4 for their ill gotten gains and money for elections ("nearly $1 million in overseas travel, campaign contributions and other benefits") and "Mr. Broidy had spent $75,000 on travel by [Hevesi], others from the pension fund and his adult children, including both his sons, people familiar with the matter said. That included five trips to Israel and once to Italy. Mr. Broidy also paid for expenses on political fund-raising trips to California."? No, the Restitution obtained by Cuomo from the [Hevesi] Wolves 2, 3, and 4 was None.
And what about Wolf 5 and his needs? Cuomo has decided "no action is warranted involving an investment increased under current Wolf 5 (Comptroller Thomas DiNapoli), a Democrat with Intermedia Partners Advisors, initially approved during (Wolf 2) Mr. Hevesi's tenure as comptroller, and [Wolf 5] is running for re-election."

Cuomo or Paladino? A Reprobate or A Builder?
Time to choose. First, look at Cuomo's history partially summarized on this blog's Index above. Cuomo is truly a Reprobate (a proliferate criminal whose crimes are reprehensible and can not be redeemed; theology: rejected by God without hope of salvation) Trillions, billions and millions of dollars stolen with Cuomo protecting the thieves.
A nationwide unemployment and under employment rate of over 17% was caused by $1.2 trillion in sub- prime mortgage loan losses caused directly by Cuomo's hand at HUD (See Cuomo's Smoking Gun HUD Directive). But that was just a beginning, Cuomo has protected and defended predatory lending, sexual abuse of women, missing 9/11 money, $40 million stolen by judges, multiple $50,000 bribes, and on and on from there.
Were these excusable errors, part of the learning curve for Cuomo, or just beyond his mental capacities? The answer is NO to all; we know Cuomo was hands on everything. Re: Request for Federal Investigation Into Allegations of Corruption and Witness Intimidation and Appointment of Federal Monitor
Gentlemen: My name is Christine C. Anderson. For 6 1/2 yrs, I was a Principal Attorney of the N Y State Appellate Division, First Dept. Disciplinary Com. (the “DDC”). The DDC is responsible for investigating and disciplining attorneys found guilty of misconduct in representing the public in the Bronx and Manhattan.
Specifically, I discovered and reported that employees of the DDC had engaged in, inter alia, the “whitewashing” [of] complaints of misconduct leveled against certain “select” attorneys and law firms. This “whitewashing” sometimes involved burying cases or destroying evidence, so that certain complaints were inevitably, unavoidably, dismissed. I witnessed this destruction of evidence myself. Other reported misconduct involves victimizing attorneys lacking privileged positions or connections.
Although the then Chief Counsel of the DDC, Thomas Cahill, stepped down in 2007, evidence clearly establishes that under the leadership of Alan Friedberg, the current Chief Counsel, Such practice robs the public of any hope at justice; it also works to the detriment of the very public the DDC is duty-bound to serve.
A Principal Attorney at the DDC, agreed to testify on my behalf at a deposition.; On the morning of her deposition, however, while en route to her deposition, Ms. Corrado was approached on the street by a supervisor at the DDC, who threatened and intimidated her with respect to her upcoming deposition testimony. Although terribly shaken, Ms. Corrado nonetheless sat for her deposition and testified truthfully. Following her deposition, however, Ms. Corrado has been subjected to further harassment and intimidation at the hands of the DDC. She has been forced to take a leave of absence as a result.
On June 8, 2009, I testified at a hearing convened by John L. Sampson, NY State Senator Shockingly, within days of my testimony, in my lawsuit, my sealed medical and psychiatric records were filed and posted publicly on the court’s Internet filing system by counsel for the defendants – i.e., the New York State Attorney General’s Office. I regard those actions as horrifically unethical and malicious, and taken in deliberate retaliation for my testifying at the Senate hearing.
The detailed testimony presented by innumerable witnesses at the June 8th Senate hearing reveals the manifold reports of corruption and abuse by the State’s Disciplinary Committees. Charges included concealment of evidence, obstruction of justice, extortionate sexual threats by attorneys, pilfering of estates by attorneys, abuse of power, fraud, conspiracy and repeated violations of state and federal constitutional rights.
Accordingly, I respectfully request that you authorize the appointment of a Special Prosecutor to investigate the epidemic of honest services fraud in the New York state court system, and the appointment of a Federal Monitor, to oversee the lawful operation of the same.

The audit said, "HUD chose an overly expensive and controversial solution that exacerbated any existing problem."

Andrew Cuomo, although MIA in prosecuting the AEG corruption, was hustling with the race pimps for their stable of voters. Did Andrew care that extra money to a pimp only goes for his wardrobe and not his stable mares? Not any more than Andrew cared for all the poor blacks victimized by his buddies while Cuomo was at HUD. Have these race pimps improved the lot of their stables since taking over the selling of their votes? Andrew "Gollum" Cuomo doesn't care, it's all about his "ring."
The AEG cash bait drops lured the race pimp, Rev. Sharpton with his stable of voters, "AEG members and a lobbyist also attempted to curry favor with the Reverend Al Sharpton by making contributions totaling almost $100,000 to the National Action Network, a group founded by him. Donations to National Action Network in 2009 included: $11,000 from AEG Chairman Richard Mays and his law firm; $13,500 from AEG member WDF; $12,500 from AEG member Levine Builders; and $25,000 from HW Funds Group, an entity associated with Joseph Logan, a member of AEG at the time. AEG lobbyist Carl Andrews, the key lobbyist who had arranged for the contributions pooled from AEG to flow to the Democratic Committee, also contributed $35,000 individually or through his firm."
Meanwhile, Andrew Cuomo hustled for money, corruption and power, "On Sunday, January 24, 2010, a New York Times article ...discussed Attorney General Andrew Cuomo’s courting of black civic leaders and clergy members in order to forestall criticism of his intended challenge to New York’s first African-American governor. Among those who met with Cuomo to discuss his potential candidacy was the [an AEG Principal] Reverend Floyd Flake, one of New York’s most influential African-American pastors."

AEG lobbyist Georgio DeRosa unambiguously described the event as a “victory” celebration. ...a March 3, 2010 invoice for $1,562,93 submitted by Andrews to AEG Chairman Mays for reimbursement for the dinner was expressly labeled “For: Victory Celebration.”

The Report says, "The Inspector General finds that the selection of a VLT operator at Aqueduct Racetrack by the Governor, the Speaker of the Assembly, and the President of the Senate (the “three men in a room”) mandated by Tax Law § 1612, as implemented resulting in the January 29, 2010 selection of Aqueduct Entertainment Group (AEG), created a politically dominated process antithetical to the public interest."
The Report has Senator Sampson, Sheldon Silver and Paterson as the three men in a room fleecing the People of NY. Andrew Cuomo, who was MIA with the prosecution of AEG corruption, tells us things will change when “three men in a room” becomes: Cuomo, Sampson and Silver.
But neither Andrew Cuomo's nor the pimps' changes have ever benefited the People of NY regardless of their color.

What difference is this from a cop who accepts your gift when he stops you for speeding? Would a jury buy your or the cop's excuse there was no quid pro quo.
What else would a jury think about Cuomo and his rich lawyers and the above $37,000 as gift (gratuity) to Cuomo and Penal law § 200.35 Receiving unlawful gratuities. You may not be aware of the Medicaid returns liability facing NY State and the costs of these Medicaid frauds to NY Counties.
