New York's Budget Is Now Cuomo's Budget And Default His Responsibility

     Assembly Speaker Sheldon Silver and Senate Majority Leader Dean Skelos laugh and smile as they pass Cuomo's budget.   Now, Andrew Cuomo owns the New York State budget.  He can't blame the legislators for passing his budget.  So, who will Cuomo blame when the revenue fails to come in and the massive borrowing begins?

     Now, there is Joy in Albany as Andrew Cuomo passes his budget and Cuomo comes to bat.  But, all the flaws reported in this blog in Cuomo's Executive budget are still there.  Most importantly, New York will run out of cash because of
1.  fantasy revenue predictions. 
2.  $3.6 billion in required spending is missing from the budget . 
3.  Cuomo's hidden taxes on business will discourage new business in New York. 
4.  Cuomo has ignored the pending suit to increase judges pay and its additonal cost to the State.  
5.  Counties and Cities will have to raise taxes to pay their 9.4% increase in Medicaid costs which is the largest expense in their budgets?

But, Hope as Cuomo comes to bat:

Then from 5 million throats and more there rose a lusty yell;

It rumbled through the Hudson valley, it rattled in the Albany dell;

It knocked upon the Adirondack mountains and recoiled throughout the State,

For Cuomo, mighty Cuomo, was advancing with his budget's plate.

There was ease in Cuomo's manner as he pranced into his place;

There was pride in Cuomo's bearing and a smile on Cuomo's face.

And when, responding to the cheers, he lightly doffed his hat,

No stranger in the crowd could doubt 'twas Cuomo at the bat.

Ten million eyes were on him as he rubbed his hands in Albany's dirt;

Five million tongues applauded when he wiped them on his shirt.

Then while the writhing tort lawyer ground the ball into his hip,

Defiance gleamed in Cuomo's eye, a sneer curled Cuomo's lip.

And now the cap on medical malpractice sphere came hurtling through the air,

And Cuomo stood a-watching it in haughty grandeur there.

Close by the sturdy batsman the malpractice cap unheeded sped-

"That ain't my style," said Cuomo. "Strike one," the doctors said.

From the crowds, black with people, there went up a muffled roar,

Like the beating of the storm-waves upon Long Island's shore.

"Kill them! Kill the lawyers!" shouted someone in the band;

And it's likely they'd a-killed them had not Cuomo raised his hand.

With a smile of Christian charity great Cuomo's visage shone;

He stilled the rising tumult; he bade the budget farce go on;

He signaled to the mandate relief pitcher, and the mandate relief spheroid flew;

But Cuomo still ignored it, and  Steve Levy said, "Strike two."

"Fraud!" cried the maddened millions, and the echos answered fraud;

But one scornful look from Cuomo and the People were awed.

They saw his face grow stern and cold, they saw his muscles strain,

And they hoped that Cuomo wouldn't let a ball go by again.

The sneer is gone from Cuomo's lip, his teeth are clenched in hate;

He pounds with cruel violence his silver spoon upon his plate.

And now the Chinese Debt Master holds the ball, and now he lets it go,

And now the air is shattered by the force of Cuomo's blow.

Oh, somewhere in our favored land the sun is shining bright;

The band is playing somewhere, and somewhere hearts are light,

And somewhere men are laughing, and somewhere children shout;

But there is default in Albany — mighty Cuomo has struck out.

New York State Debt per person including local debt is $24,195.  For a family of four that is about $97,000. That is the highest in the USA.  And surprise, Cuomo's budget revenue predictions were a farce.

   Here's the deeds from Cuomo's Medicaid Redesign Team: "The consumer advocacy group the Center for Justice and Democracy is calling on Medicaid Redesign Team member and Cuomo confidante Jeffrey Sachs to release “a sworn affidavit that you have not discussed the Medicaid Redesign Team or any issue covered by the Medicaid Redesign Team with any of your clients and to explain exactly what services you are being paid for by these clients and how much.”  and "You have 'quickly emerged as a leader on the governor’s 27-person Medicaid redesign team' while “working as a paid consultant to some of the biggest players in the New York health care industry, including Mount Sinai Medical Center, NYU Langone Medical Center and the state’s largest association of nursing homes, all of which have financial interests at stake in the coming Medicaid changes.”

3. "Number 2 is going to be cleaning up Albany and restoring trust because Bob [Duffy] is right, you have nothing without trust."

4."Too often government responds to the whispers of the lobbyists before the cries of the people."

Will Andrew Cuomo Clean Out The Albany Swamp And Remove Chief Judge Lippman?

   The Committee on Public Integrity is asking the FBI and Andrew Cuomo to ACT Now on the Creimes of Chief Judge Lippman.   This was reported on this blog in a post months ago. 
     The necessary steps were presented in a prior post on this blog  Misuse Of Public Funds By New York Chief Judge Demands Andrew Cuomo Act

     Andrew Cuomo is aware and has received criminal complaints against Judge Lippman.and has a duty to direct Attorney General Schneiderman to prosecute.  Andrew Cuomo can immediately ask the New York legislature to remove Judge Lippman from office.


     Here, Andrew, is the applicable law to remove Judge Lippman:

Criminal prosecution using Penal Laws of New York:  >§ 155.05 Larceny; defined. 1. A person steals property and commits larceny when, with intent to deprive another of property or to appropriate the same to himself or to a third person, he wrongfully takes, obtains or withholds such property from an owner thereof

§ 155.42 Grand larceny in the first degree. A person is guilty of grand larceny in the first degree when he steals property and when the value of the property exceeds one million dollars. Grand larceny in the first degree is a class B felony.

Using the NY Constitution~Article VI § 23. Removal of certain judges and justices, by legislature;

§ 23. a. Judges of the court of appeals and justices of the supreme court may be removed by concurrent resolution of both houses of the legislature, if two-thirds of all the members elected to each house concur therein.

     Here, Andrew, is your duty under New York Executive Law to prosecute Judge Lippman:
Law § 63. General duties of Attorney General. 2. Whenever required by the governor, attend ...any term of the supreme court or appear before the grand jury thereof for the purpose of managing and conducting in such court or before such jury criminal actions or proceedings ...in which case the attorney-general or his deputy so attending shall exercise all the powers and perform all the duties in respect of such actions or proceedings, which the district attorney would otherwise be authorized or required to exercise or perform; 

   Andrew Cuomo and/or Attorney General Scheiderman can remove Judge Lippman from office with

§ 63-a. Action by attorney-general for forfeiture of public office.
The attorney-general may maintain an action, upon his own information or upon the complaint of a private person, against a public officer, civil or military,who has done or suffered an act which by law works a forfeiture of his office.

But how will Cuomo act? 

 1. As an indecisive Hamlet:

Trust In Andrew Cuomo's Inaugural Speech Was Not Verified

 Let's apply this to Cuomo's Inaugural Speech.    Look at all the trust, believe, and restore Cuomo asks you to do.
Cuomo says in Inaugural speech,"That’s what this administration is going to be all about — restoring the pride, making the government work, my friends. Now look at his failed record as Attorney General: Cuomo in the Albany Swamp   and  Cuomo's M.O.

Here's what Cuomo says in Inaugural speech, about immediate action:
"There is no more time to waste. It is a time for deeds, not words, and results, not rhetoric. It is time for a bold agenda and immediate action. There is no more waiting for tomorrow and there are no more baby steps, my friends."
But, he still hasn't  followed up on most of California's Brown's proposals reported here, beginning with
1. Brown has already pledged to cut his own office budget by 25%.

Cuomo says in Inaugural speech, "The special interests who have ruled our government for years must give way to the people’s agenda." and "Number 2 is going to be cleaning up Albany and restoring trust because Bob [Duffy] is right, you have nothing without trust." and "Too often government responds to the whispers of the lobbyists before the cries of the people." 
But, "Nearly half of the people on Cuomo's transition team and economic advisory council either are registered lobbyists themselves or work for organizations that lobby New York's state government ?

Cuomo says in Inaugural speech, "They can’t afford the never-ending tax increases in the State of New York and this state has no future if it is going to be the tax capital of the nation. We have to send that signal this session by passing a property-tax cap."

But,  3. [Governor] Brown to take aim at several tax breaks and subsidies that have been fiercely guarded by the business lobby; and 7. [Governor]Brown targeted a recent change to state business tax formulas that has saved corporate California roughly $1 billion.

Cuomo says in Inaugural speech, "The words “government in Albany” have become a national punch line. And the joke is on us. But what's Cuomo doing about,  

"An eight-month probe by state Inspector General Joseph Fisch of one of the largest-ever state contracts — a 30-year franchise to run a downstate casino worth potentially billions of dollars — reveals an almost breathtaking array of abuses by top Democratic officials controlling the legislative and executive branches."

Andrew Cuomo Cheered As Swamp King While He Gives A Second Companion Piece Thank You

The Albany Swamp held their Rejoice Party this week and watched  new videos of the Swamp's vermin.

             The King Returns In Triumph


They watched the vermin, Charley Rangel, strut "his striped tie, his red pocket handkerchief bright and cheery enough to attract hummingbirds and on his finger, a glittering ring the size of a butter plate."   The Swamp roared with laughter, "ethics committees, ethics committees, so much better than a jail cage."

And the laughter continued as Andrew Cuomo said, "[I'm]hesitant to empower Eric Schneiderman to investigate public corruption at the attorney general’s office," and "would prefer a comprehensive change of the government through an ethics bill he hopes to pursue in the Legislature next year." And the swamp exploded, "An ethics probe, an ethics probe, just like the Rangel ethics probe."

Then Cuomo pulled out his CuomoTARP again and threw it over a stinking swamp pit saying,"I want to see what happens with the ethics reform with the Legislature, before I lift my CuomoTARP."    And the Swamp chorus roared: "Yeah, yeah, Andrew, Only after Godot returns, next year.

     The Swamp laughed as the new Attorney General, Scheiderman, crawled into the Swamp and threw a tantrum crying "that silver spoon feed brat, Andrew, has taken away my toys."

    Then Swamp King Andrew's, new Cleaning Up Albany Together video played where Andrew promises at 2:03 minutes to lift the CuomoTARP he's kept over NY corruption for the last four years.  When the video concluded, Andrew told the swamp, "Remember in 2008, when I promised in my 'CAP' (Cuomo's Amnesty Program) that 'Heads will role once the Amnesty Program ends,' well, I scored a  thousand percent (1000%), because after my last 4 years on the job, absolutely nothing happened."   And the Swamp chorus, "Lift the TARP; lift the TARP, Andrew,  but only after Godot returns next year.



     Then Andrew gave his Second Thank You (The Swamp Version of Cleaning Up Albany) Address to the faithful in the Swamp.

I'm King thanks to your money; your lies; your cheating; you did whatever to make me King.

My loyalty is to this swamp; regardless of what I say outside.

You know my record; the indictments not obtained; the cases settled without restitution or jail time.

You're my extended family. 

This Swamp has drainage in all 62 Counties where you knew I would protect you.

Ethics Boards and Commission Investigations weren't jail or restitution. 

My game, nothing happens until the legislature creates ethics probes;  then I blame them and wait another year for a Commission Investigation.

This Swamp has been around a long time and I'll keep it thriving.

Sampson and Cuomo Kiss And Make-up In The Albany Swamp To Guard Their Status Quo

         "An election full of Sound and Fury about draining the Albany Swamp was just a tale told for the fools and signified nothing."

      From the center of the swamp, Senator Sampson announced,“If 2008 was about the changing of the guard, then 2010 was about the guarding of the change.  Working with Governor-elect Cuomo, Lieutenant Governor-elect Duffy, we stand ready to continue what we started and build the New York we can be, should be, and will be."   "I look forward to working side-by-side with Andrew Cuomo and Robert Duffy."

       Of course, no word from Senator Sampson who "is among the lawmakers caught up in the scandal over a since-scuttled contract for a lucrative downstate casino. Federal prosecutors and the Manhattan district attorney's office is looking at possible criminal violations," about that AEG corruption or the multiple $50,000 bribes.

       The Albany Swamp's vermin had united to save their Swamp and heeding the words of "Pogo," "We have met the enemy and he is us." did nothing.

   Brooklyn Democratic boss Vito Lopez and his massive social-services empire faces two federal investigations into alleged improprieties.   But, Cuomo said  Lopez, "is my good friend;" "We do a lot of good work together." while seated across from Lopez during a gathering with Hasidic leaders in Williamsburg.    Lopez, who definitely needs Andrew's continued indulgence, is preparing to lead the chorus for "What a friend we have in Andrew" hymn on the left side of this blog.

   The Slime Covered Swamp Vermin in the NY Legislature who Cuomo promised to clean out are now Cuomo's friends.  Cuomo said, “I don’t believe there’s going to be a confrontation. The Legislature doesn’t want trouble. They want good news from a P.R. point of view. They need redemption. They need a friend. Eliot could have been their best friend. I think I can be their best friend.”

    David Paterson, as friend? or as obedient house boy who knows where his goose could be cooked and won't upset the Cuomo apple cart?

  Andrew Farkas, rehabilitated after, "Cuomo accused Farkas of paying millions in kickbacks to the owners of buildings that Insignia managed, and the company settled the case by paying a hefty fine. But the two apparently patched up their dispute: Cuomo later took a high-paying position with Insigna"


     Allen Isaac, who hopefully learned why Audrey says, "There's no free lunch."  Along with all the other reprobates, crooks, and others exposed in this blog.

    And on a high rock of honor ($18 million price), which he purchased, is Farkas, who profited from mortgage crisis here in NY and profited from his misdealings in United Arab Emirates.   "Thanks to Farkas, Cuomo’s current campaign war chest for governor is $18 million – big enough to eliminate primary competition before it starts. With a past already raising uncomfortable questions for Cuomo, Farkas is deeply embedded in controversial Middle East financial dealings, having created a “Fannie and Freddie for Dubai” in the United Arab Emirates. A quick wheeler-dealer, Farkas bailed out before the Emirate’s colossal credit crisis, and made a string of similarly well-timed deals with Dubai World in 2009, with whom he flipped marquee Manhattan properties."

     Although the stench under the CuomoTARP tent should be extreme from the combined Albany swamp vermin, reprobate politicians, crooks and Spitzer's doll, high powered fans are in operation.   Do you expect Andrew to become "Lord Potentate of the Swamp"?  Do you want to be Andrew's friend under the Cuomo TARP tent?  You need to pay up and/or enhance your infamy portfolio.

        Is Andrew incompetent, or a clever cheat scheming to enrich himself and pals,  or a spoiled brat who's been taught that he's owed something, or Gollum obsessed with the "ring"?     It doesn't matter, he needs to be stopped.

       Luckily, an alternate opportunity opened up with Spitzer's low ratings and desperate need of a stylist.  
 Spitzer's madam reports, "That is sort of synonymous of what the girls told me about him in bed, that he was boring, so I guess the expectations were met." and "I read that they were investing all this money in a stylist and I thought no matter what money you throw at this man, at the end of the day, he's still a gremlin and a dishonest, corrupt career politician whose only interest is rehabilitating his own image enough to get back into politics."

          You, Andrew, although you are a corrupt, dishonest career politician, you're a handsome gremlin and not much money needs be spent on a stylist.   You didn't cheat on your wife, she cheated on you and, hopefully, she won't report you were a dud in bed.   You're an ideal Spitzer's replacement and your ratings can only exceed Spitzer's dismal ratings.

Andrew Cuomo, Full Of Sound And Fury Has Met The Enemy...And It's Him

Like the cartoon character Pogo, Cuomo thrives but in the different Albany swamp.  But unlike Pogo, Cuomo is unable to utter the words, "We have met the enemy... and he is us."   Cuomo looks everywhere around him in his acknowledged swamp and says, "The government is dysfunctional;"  "There needs to be a new culture. You need to bring in new people. We have to remake the entire state government."   Cuomo needs a mirror.

      The Amsterdam News reports that Cuomo feels he is entitled to votes from New York City and the black community.  But the Amsterdam News asks Cuomo,"Where have you been? Where have you been these last four years? Your ads say that you have been there for New York, but for which New York? Do you mean Black and Brown New York? Upstate New York? Rich New York?"   The answer is Cuomo has been there for the corrupt, the whitewashing, the endless investigations going nowhere, and for serving as lawyer in Federal and State Court for corrupt criminal State employees.   And Cuomo has been there for the Black community, when he has appointed his father's toady, Judith Kaye (who never prosecuted a case), to persecute, but not prosecute Governor Paterson.  Probably for this and his legacy entitlement from Mario, that Cuomo hopes his sound and fury performances will fool enough idiots, whether Black, White, Yellow or Brown.
