Andrew Cuomo Hopes To Fool NY Sheeple About Wolf 2, Alan Hevesi, Going To Jail

              "The wolf guarding the sheep."

More sound and fury from Wolf 1 (Andrew Cuomo), about prosecuting Wolf 2 (Alan  Hevesi), and signifying another wolf on the sheeple scam.  Look, the Devil hides in the details.
  1.  "Approval from Mr. Cuomo not to prosecute his [Alan Hevesi's] two sons, Wolf 3 (Assemblyman Andrew Hevesi) and former state senator  Wolf 4 (Daniel Hevesi)."
   2.  And then revealed through Carl Paladino, in Plattsburgh, yesterday, "Cuomo is recommending no jail time for Wolf 2 (Alan Hevesi)."
    3. The fooled sheeple will be told after election of Cuomo's plea bargain recommendation "to give him probation." so that Wolf 2, (Alan Hevesi), won't go to jail.

Now look at restitution that resulted from Wolf 1 (Andrew Cuomo):  "Markstone Capital agreed in February to repay $18 million in management fees to the Common Retirement Fund."  and  "Quadrangle agreed in April to pay $12 million to settle investigations by Mr. Cuomo and the Securities and Exchange Commission."
Was restitution obtained by Cuomo from the (Hevesi) Wolves 2, 3 and 4 for their ill gotten gains and money for elections ("nearly $1 million in overseas travel, campaign contributions and other benefits") and "Mr. Broidy had spent $75,000 on travel by [Hevesi], others from the pension fund and his adult children, including both his sons, people familiar with the matter said. That included five trips to Israel and once to Italy. Mr. Broidy also paid for expenses on political fund-raising trips to California."?     No, the Restitution obtained by Cuomo from the [Hevesi] Wolves 2, 3, and 4 was None.

And what about Wolf 5 and his needsCuomo has decided "no action is warranted involving an investment increased under current Wolf 5 (Comptroller Thomas DiNapoli), a Democrat with Intermedia Partners Advisors, initially approved during (Wolf 2) Mr. Hevesi's tenure as comptroller, and [Wolf 5] is running for re-election."

Wolf 1 (Andrew Cuomo) showed his compassion and his tremendous job in protecting Wolves 2, 3, 4 and 5.     Andrew hopes his sheeple will be drowsing until after they elect their new Shepherd, Wolf 1 (Andrew Cuomo).

A CuomoTARP wake up trumpet blast, "wake up, Sheeple, and drive Wolf 1 (Andrew Cuomo), and the other wolves out."   Read the endorsement of Carl Paladino in the post below.

Cuomo or Paladino? A Reprobate or A Builder?

Time to choose.  First, look at Cuomo's history partially summarized on this blog's Index above.   Cuomo is truly a Reprobate (a proliferate criminal whose crimes are reprehensible and can not be redeemed; theology: rejected by God without hope of salvation)  Trillions, billions and millions of dollars stolen with Cuomo protecting the thieves.

A  nationwide unemployment and under employment rate of over 17% was caused by $1.2 trillion in sub- prime mortgage loan losses caused directly by Cuomo's hand at HUD (See Cuomo's Smoking Gun HUD Directive).  But that was just a beginning, Cuomo has protected and defended predatory lending, sexual abuse of women, missing 9/11 money, $40 million stolen by judges, multiple $50,000 bribes, and on and on from there.

Were these excusable errors, part of  the learning curve for Cuomo, or just beyond his mental capacities?  The answer is NO to all; we know Cuomo was hands on everything.  It's reported that Andrew Cuomo was personally involved in everything in his office (likely, this was leaked by his underling "rats", who feared being blamed or prosecuted)

Andrew has been found reprobate.   The only argument for Cuomo is, "Better the devil we know."  But Cuomo is more than an ordinary devil; he's better described as "A Devil Incarnate"  (Incarnate is in the flesh)

Now, we look at Paladino and we're told he sent off color jokes in e-mails; he didn't present proof that Cuomo had affairs, when he only asked, why the media didn't ask the same questions of Cuomo.

Re: the media "Things aren't what they seem, skim milk masquerades as cream" Gilbert and Sullivan
For any media trusting suckers on the right, Reporter Fred Dicker now works for the NY Post, but Mr. Dicker was leader of Students for a Democratic Society (SDS) and was dispatched to the University of Massachusetts  by the leading theorist of American communism, Herbert Aptheker.   And for NY Times media trusting suckers on the left check out Michael Moore on the NY Times.   These media monkeys, fours years earlier, gave us Spitzer, when they all knew he was crooked and corrupt (we begged them for help)   Did you trust these media, when they anointed Spitzer?   Trust them now and we'll have a Andrew Cuomo protected crime tsunami, whose origin was reported on this blog, engulfing and drowning the entire State.

Let's look at the men.  Cuomo - career politician;  successes- none;  failures- monumental,  spoiled brat son of Mario;  a wake of destroyed jobs, lives and fortunes.

Paladino - hard working construction man;  success after success;  jobs for people;  new businesses constructed;  in his wake;  improved lives;  improved communities; he raised himself up - he was not dragged up by his father.

Would Cuomo thwart the AEG scandal prosecution - certainly, he's part of it.  Trillion, billions, millions of  dollar losses will only be his starting point.   Will Cuomo prosecute the criminals stealing from the NY State? - why no, they're his friends.  For the last four years, Cuomo could have begun to drain the Albany swamp, but no, he's promised to drain it in his next four years and, please, take one of those red and blue suckers on your way out, sucker!  Reduce State spending - unlikely, Cuomo is endorsed by Acorn's Working Families Party.

Paladino - can build on his successes -yes;  Drain the Albany Swamp -yes;  Prosecute the criminals stealing from the State  -yes;  Reduce state spending. -sure, he doesn't owe them anything.

Other candidates: You think your protest vote counts, while Cuomo will just laugh at your stupidity in not voting him out and then he'll steal you blind.  Take another a multicolor sucker, because that's all you're going to get, sucker.

The only intelligent choice, Carl Paladino

Andrew Cuomo Caught While Using His M.O. To Protect Crooked Connected NY Lawyers in Federal Court And Disciplinary Committees

The Vatican Museum was asked to have"Janus"chiseled out and the modern name "Saint Andrew conquers NY" chiseled in

Attorney, Christine Anderson, has smoked out of the NY Swamp, the "Swamp Boss" AG Andrew Cuomo.  Ms. Anderson caught Andrew in Federal Court while he was defending and supporting the corruption and crimes by NY State employees as the Official Policies of NY State.     It was the same Cuomo M.O.    Andrew Cuomo, the two faced modern version of Janus, had his one face to the public full of his sound and fury about draining the Albany and NY Swamps while Cuomo's other face was helping his connected paid up law firms escape jail and attorney discipline.   Christine Anderson says it best below in a condensed copy of her letter to US AG Holder, the FBI and others.     FULL Text of Anderson letter is here    Link to video of her testimony
The condensed letter of Christine Anderson describes the crimes (in red) tolerated and accepted as Official NY Policy by Andrew Cuomo in Federal Court.  Although Cuomo has so  far escaped, I've copied a warning from an earlier post  to Cuomo.
Andrew, your M.O. pattern (execute the crimes, prevent their detection and/or facilitate escape) smells like enterprise corruption, where the enterprise is your public office at HUD or as Attorney General.
NY Penal Law Article 460 - ENTERPRISE CORRUPTION
Is R.I.C.O. in your future, Andrew, with a new Governor or with Eric Holder out as US AG?     Imagine, the People can get the loot back from each of you and jail, too.

LETTER:
Christine C. Anderson, Attorney at Law

To: The Hon. Preet Bharara, US Attorney Southern District of NY;
Hon. William M. Welch II, Chief, Public Integrity Unit, US Dept. Justice;
The Hon. John L. Sampson,Chairman, NY State Senate Judiciary Committee
Re: Request for Federal Investigation Into Allegations of Corruption and Witness Intimidation and Appointment of Federal Monitor

Gentlemen: My name is Christine C. Anderson. For 6 1/2 yrs, I was a Principal Attorney of the N Y State Appellate Division, First Dept. Disciplinary Com. (the “DDC”). The DDC is responsible for investigating and disciplining attorneys found guilty of misconduct in representing the public in the Bronx and Manhattan.

Specifically, I discovered and reported that employees of the DDC had engaged in, inter alia, the “whitewashing” [of] complaints of misconduct leveled against certain “select” attorneys and law firms. This “whitewashing” sometimes involved burying cases or destroying evidence, so that certain complaints were inevitably, unavoidably, dismissed. I witnessed this destruction of evidence myself. Other reported misconduct involves victimizing attorneys lacking privileged positions or connections.

Although the then Chief Counsel of the DDC, Thomas Cahill, stepped down in 2007, evidence clearly establishes that under the leadership of Alan Friedberg, the current Chief Counsel, Such practice robs the public of any hope at justice; it also works to the detriment of the very public the DDC is duty-bound to serve.

A Principal Attorney at the DDC, agreed to testify on my behalf at a deposition.; On the morning of her deposition, however, while en route to her deposition, Ms. Corrado was approached on the street by a supervisor at the DDC, who threatened and intimidated her with respect to her upcoming deposition testimony. Although terribly shaken, Ms. Corrado nonetheless sat for her deposition and testified truthfully. Following her deposition, however, Ms. Corrado has been subjected to further harassment and intimidation at the hands of the DDC. She has been forced to take a leave of absence as a result.

On June 8, 2009, I testified at a hearing convened by John L. Sampson, NY State Senator Shockingly, within days of my testimony, in my lawsuit, my sealed medical and psychiatric records were filed and posted publicly on the court’s Internet filing system by counsel for the defendants – i.e., the New York State Attorney General’s Office. I regard those actions as horrifically unethical and malicious, and taken in deliberate retaliation for my testifying at the Senate hearing.

The detailed testimony presented by innumerable witnesses at the June 8th Senate hearing reveals the manifold reports of corruption and abuse by the State’s Disciplinary Committees. Charges included concealment of evidence, obstruction of justice, extortionate sexual threats by attorneys, pilfering of estates by attorneys, abuse of power, fraud, conspiracy and repeated violations of state and federal constitutional rights.

Accordingly, I respectfully request that you authorize the appointment of a Special Prosecutor to investigate the epidemic of honest services fraud in the New York state court system, and the appointment of a Federal Monitor, to oversee the lawful operation of the same.

Very truly yours, Christine C. Anderson

Thank you, Christine Anderson

And to Andrew, no whitewashing even by your "cleaner" at the Disciplinary Committee can remove your stains.

Cuomo Perfected His M.O. At HUD With $59 Billion Unaccounted For

Modus operandi, M.O.,  is a Latin phrase, approximately translated as "method of operating".  The term is used to describe someone's habits or manner of working, their method of operating or functioning.  It largely consists of examining the actions used by the individual(s) to execute the crime, prevent its detection and/or facilitate escape.

The WSJ reported on10/23/2010, "Audit Faulted Cuomo's HUD Overhaul,"  how the Inspector General's audit said Cuomo had impeded investigators examining the program and had asked "the Inspector General's office for the names of HUD employees who spoke with auditors."   The audit said, "HUD chose an overly expensive and controversial solution that exacerbated any existing problem."
Cuomo's M.O. examples:    1. Now combine the above audit with the missing $59 Billion at HUD which was never accounted for and you see the first known use by Andrew Cuomo of his M.O. with his staff full of sound and fury while covering up a massive $59 Billion theft.  Was this the CuomoTARP's  first use to hide all the scurrying vermin (connected friends of Cuomo) devouring $59 Billion dollars.

    2. "The General Accounting Office (GAO)...in 2000 found that the Department was allowing lenders in the federally-insured mortgage business to engage in fraud and “flipping” that left homebuyers with crumbling houses and unaffordable mortgage payments. The fraudsters would buy property, often in poor neighborhoods, make cosmetic repairs and get puffed up property appraisals based in part on falsified documents attesting that homes had been renovated."    Same M.O., Cuomo's staff full of sound and fury looking out for the poor guy, while the crooks are stealing the poor guys blind.

    3. And Cuomo repeated this with NY Medicare's 1.2 per year fraud  Same Cuomo M.O., Cuomo's Attorney General's Office full of sound and fury is looking out for the elderly and infirm, while $1.2 Billion dollars per year is gone and not to the elderly and infirm.

    3.  Multiple $50,000 bribes to Senator Sampson and others, while the Cuomo's AG Public Integrity Office blusters.   Same Cuomo M.O.     Senator Sampson walks while Cuomo's Office  talks.

     4. Cuomo's AG Office spouts its toughness on crime, while it bungles a criminal trial and the rich executives walk    Same Cuomo M.O.

      5.  The AEG scandal slips under the sound and fury of Cuomo's Public Integrity Unit.    Cuomo avoids being directly named in Inspector General's report, but the "Victory Celebration" required Cuomo to be in the bag.   The same Cuomo M.O. , but his smoking gun was found.

     6. This whole blog is about Cuomo's cover-ups with his CuomoTARP, while the public is ripped off and abused.    It's the same Cuomo M.O. - Diversionary Sound, Fury and Bluster covering up crimes

Andrew, your M.O. pattern (execute the crimes, prevent their detection and/or facilitate escape) smells like enterprise corruption, where the enterprise is your public office at HUD or as Attorney General.
NY Penal Law Article 460 - ENTERPRISE CORRUPTION
460.20 - Enterprise corruption.    460.30 - Enterprise corruption; forfeiture.    460.40 - Enterprise corruption; jurisdiction.    460.50 - Enterprise corruption; prosecution.    460.60 - Enterprise corruption; consent to prosecute.    460.70 - Provisional remedies.     460.80 - Court ordered disclosure.

Is R.I.C.O. in your future, Andrew, with a new Governor or with Eric Holder out as US AG?     Imagine, the People can get the loot back from each of you and jail, too.

Next and coming, Cuomo in other RICO Fraud, Cuomo in "Iviewit" Patent Fraud , Cuomo creates a giant liability for NY State.

Andrew Cuomo Defends His "Official Tolerated Abuse Of Women Policy"

"Hell is empty and all the Devils are here." Shakespeare

Andrew Cuomo has married his "Soul" and "pledged its troth" to a harem of rich crooked lawyers, financiers and others, who likewise sold their souls.    Thus pledged, Andrew has serially protected his "harem's reprobates" who've abused and assaulted women.

Andrew, what do you tell your daughters when they hear your protected sex predator in his own words in action on Youtube?

http://www.youtube.com/watch?v=1VPIxOiuT9Q&feature=related

This blog posts showed in "Cuomo can clean sex abuse from his own nest" and Isaac's former legal secretary how Andrew misused his power as Attorney General to protect/defend a well connected lawyer, Allen Issac, from criminal charges and thus acting as an accessory in violation of NY Penal Law § 20.00 Criminal liability for conduct of another.   When one person engages in conduct which constitutes an offense,  another person is criminally liable for such conduct when, acting with  the mental culpability required for the commission thereof, he ... intentionally aids such person to  engage in such conduct.

Andrew Cuomo deliberately refrained from his duties under his oath required by the NY Constitution to protect Ms. Esposito from NY Penal Law defined criminal conduct described by investigators as "Felony Level Sexual Abuse, Coercion And Soliciting Sex From His Client, Obstruction of Justice, etc."

In so doing, did Andrew Cuomo deprived Ms. Esposito of a benefit when he knowingly refrained from enforcing the laws of NY in violation of NY Penal Law § 195.00 Official misconduct.  A public servant is guilty of official misconduct when, with intent to obtain a benefit or deprive another person of a benefit:  2. He knowingly refrains from performing a duty which is imposed upon him by law or is clearly inherent in the nature of his office.?

But Cuomo's acquiescence to Abuse of Women by NY Government didn't end there.  Andrew Cuomo is and was also using NY State money and his office defending, in federal court, a cabal of NY employed crooks and miscreants at the NY Attorney Discipline Committee against a whistle-blower, "Christine Anderson."

In this short video of Christine Anderson's testimony before the NY Senate Judiciary committee note that Ms. Anderson gives only a few examples and there are references to confidential information (not any more).  The first person you hear and see is the infamous AEG implicated Senator Sampson, described by an incredulous Inspector General, Fisch, as,."This is Sen. Sampson," [who gave] confidential information to Carl Andrews, a former state senator and AEG lobbyist at the time.  Sampson's lack of recall during his interview with investigators was remarkable.  "I stopped counting the number of 'I don't recalls' when I reached 100," he said of Sampson's testimony." ,

Why, Andrew, did use use NY State money to defend the physical criminal assaulter of Ms. Anderson in Federal Court?   And, why did you use NY State money to protect and defend your other reprobate rich large law firms abusing women as testified to by women at the NY Senate Hearings.    Andrew, what do you tell your daughters about your abusing Ms. Esposito, Ms. Anderson and other women by protecting these well connected lawyers?

An e-mail with this blog post will be sent to NY NOW (info@nownys.org) for a response about this serial mistreatment of women as your Official NY Public Policy or had NOW provided indulgences for you and your "friends"?   NOW's response will be published here, or if NOW chooses, in the comments.

Coming:  A multitude of crimes in Federal Court testified to by Ms. Anderson and others which was covered -up and defended by Andrew Cuomo.

The Second Cuomo's Smoking Gun: AEG Victory Celebration Needed Rev. Sharpton And Andrew Cuomo In The AEG Bag

Here Boys, Here, Come Sharpton, Come Sampson, Come Silver, Come Cuomo, ...

Conclusions from reading the Inspector General Report on AEG with its criminal recommendations and the "Victory" celebration:
Andrew Cuomo, although MIA in prosecuting the AEG corruption, was hustling with the race pimps for their stable of voters.  Did Andrew care that extra money to a pimp only goes for his wardrobe and not his stable mares?    Not any more than Andrew cared for all the poor blacks victimized by his buddies while Cuomo was at HUD.  Have these race pimps improved the lot of their stables since taking over the selling of their votes?    Andrew "Gollum" Cuomo doesn't care, it's all about his "ring."

The AEG cash bait drops lured the race pimp, Rev. Sharpton with his stable of voters, "AEG members and a lobbyist also attempted to curry favor with the Reverend Al Sharpton by making contributions totaling almost $100,000 to the National Action Network, a group founded by him. Donations to National Action Network in 2009 included: $11,000 from AEG Chairman Richard Mays and his law firm; $13,500 from AEG member WDF; $12,500 from AEG member Levine Builders; and $25,000 from HW Funds Group, an entity associated with Joseph Logan, a member of AEG at the time. AEG lobbyist Carl Andrews, the key lobbyist who had arranged for the contributions pooled from AEG to flow to the Democratic Committee, also contributed $35,000 individually or through his firm."

Meanwhile, Andrew Cuomo hustled for money, corruption and power, "On Sunday, January 24, 2010, a New York Times article ...discussed Attorney General Andrew Cuomo’s courting of black civic leaders and clergy members in order to forestall criticism of his intended challenge to New York’s first African-American governor. Among those who met with Cuomo to discuss his potential candidacy was the [an AEG Principal] Reverend Floyd Flake, one of New York’s most influential African-American pastors."

And wasn't Andrew in the bag already, when "before a completed memorandum of understanding had even been submitted for approval to the Attorney General or State Comptroller, a number of AEG principals and lobbyists gathered for a celebration at AEG lobbyist Carl Andrews’s home. ... AEG lobbyist Georgio DeRosa unambiguously described the event as a “victory” celebration. ...a March 3, 2010 invoice for $1,562,93 submitted by Andrews to AEG Chairman Mays for reimbursement for the dinner was expressly labeled “For: Victory Celebration.”
Why did they think they had Andrew in the bag?  Maybe, because Andrew Cuomo had got his cut in the AEG action, "Nor does it change the fact that Cuomo has received campaign contributions from individuals and companies aligned with the scandal, including Levine Builders, Turner Construction, Greenstar Services, and Floyd Flake."

The Report says, "The Inspector General finds that the selection of a VLT operator at Aqueduct Racetrack by the Governor, the Speaker of the Assembly, and the President of the Senate (the “three men in a room”) mandated by Tax Law § 1612, as implemented resulting in the January 29, 2010 selection of Aqueduct Entertainment Group (AEG), created a politically dominated process antithetical to the public interest."

The Report has Senator Sampson, Sheldon Silver and Paterson as the three men in a room fleecing the People of NY.  Andrew Cuomo, who was MIA with the prosecution of AEG corruption, tells us things will change when “three men in a room” becomes: Cuomo, Sampson and Silver.
But neither Andrew Cuomo's nor the pimps' changes have ever benefited the People of NY regardless of their color.

Andrew, your second smoking gun is found?  A Victory Celebration needed you in the bag, right?

MIA Andrew Cuomo Found Feeding At AEG Cash Bait Drop In Albany Swamp

"When you're an integral part of the feeding frenzies of the alligators, you don't drain the swamp"
             Andrew, you've gotten fat!

Put on your hip boots and a clip on your nose and wade into the Swamp and barf directly into the swamp and not on someone else when you hear Andrew Cuomo croaking, “The basic premise is, well, if people give you money maybe you’ll be influenced. Not if you have integrity, and if you don’t have integrity you’ll be influenced because of the money, you’ll be influenced because of the politics, you’ll be influenced because somebody is a friend of somebody.”

Smell the latest swamp gas bubble: "An eight-month probe by state Inspector General Joseph Fisch of one of the largest-ever state contracts — a 30-year franchise to run a downstate casino worth potentially billions of dollars — reveals an almost breathtaking array of abuses by top Democratic officials controlling the legislative and executive branches."

Be astonished at the stench just as an incredulous Inspector General, Fisch, who said,."This is Sen. Sampson," [who gave] confidential information to Carl Andrews, a former state senator and AEG lobbyist at the time.  Sampson's lack of recall during his interview with investigators was remarkable.  "I stopped counting the number of 'I don't recalls' when I reached 100," he said of Sampson's testimony."
"Every single major leader of the Senate Democrats is being recommended to the federal prosecutor or the district attorney to be investigated criminally"

See the Senate Democrats feeding at the AEG cash bait drop joined by a hungry Andrew Cuomo,  "Of course he did receive contributions from the players in the AEG scandal." "Nor does it change the fact that Cuomo has received campaign contributions from individuals and companies aligned with the scandal, including Levine Builders, Turner Construction, Greenstar Services, and Floyd Flake."

We've located in the Albany Swamp Andrew Cuomo, whose integrity he says is above reproach.  He wasn't MIA in this scandal, nor draining the Albany Swamp.  He was battling to get his fair share at the AEG cash bait drop in the Albany Swamp.

Remedy For Andrew Cuomo Says It's A Crime When You Do It, But Not When I Do It

We have a modern day version of the "Emperor's New Clothes" with a fawning crowd of media monkeys and Professors praising our Emperor To Be, Andrew Cuomo, for promising to clean out the Albany Swamp Vermin and his courageous effort to end corruption in the Comptroller's office.    These media monkeys and Professors, fearful of being the only one to speak the truth, refuse to acknowledge what they all see with their eyes that their Emperor to Be's transparent garment reveals a large corrupt Albany Swamp Vermin.

The Emperor to Be, Andrew Cuomo, demands his own laws.   The People of NY's laws are just  for them or the NY Comptroller's Office.  Here's The Emperor to Be's rules for contributions:  "where on his donation forms,  contributors [are asked] to sign a statement saying they have no 'matter' pending with him. That rule does not extend to attorneys representing persons or entities with matters before the NYS Attorney General’s office.

Some of The Emperor to Be's biggest contributions have come from lawyers, including some who represent clients investigated by the Attorney General's Office.   For example, he accepted $37,000 from Boies Schiller & Flexer, a New York City firm, even though David Boies, one of the nation's pre-eminent trial attorneys, represented a former insurance and financial services executive under investigation by Cuomo's office.

The Emperor to Be suspended for himself:
Penal law § 200.11 Bribe receiving in the second degree.
A public servant is guilty of bribe receiving in the second degree when he solicits, accepts or agrees to accept any benefit valued in excess of ten thousand dollars from another person upon an agreement or understanding that his vote, opinion, judgment, action, decision or exercise of discretion as a public servant will thereby be influenced. Bribe receiving in the second degree is a class C felony.

What citizen of NY on a jury and not drinking Cuomo's Kool aid would think that the $37,000 (in excess of ten thousand dollars) from Boies Schiller & Flexer was not given with the understanding that Cuomo's judgment, action, or exercise of discretion as a public servant will thereby be influenced.   What difference is this from a cop who accepts your gift when he stops you for speeding? Would a jury buy your or the cop's excuse there was no quid pro quo.

What else would a jury think about Cuomo and his rich lawyers and the above $37,000 as gift (gratuity) to Cuomo and Penal law § 200.35 Receiving unlawful gratuities. A public servant is guilty of receiving unlawful gratuities when he solicits, accepts or agrees to accept any benefit for having engaged in official conduct which he was required or authorized to perform, and for which he was not entitled to any special or additional compensation. Receiving unlawful gratuities is a class A misdemeanor.

Here's the now grown old little boy's call-out to the  media monkeys and Professors.  Your Emperor to Be is just a crook.     Here's what needs to be done: A Sworn Criminal Complaint was sent to Governor Paterson's Office today.   Governor Paterson can under the NY Constitution send this complaint to the Attorney General's office with instructions for appointing a Special Prosecutor.   Now Dave, can return the favor to Andrew!

State of New York, County of Essex ss:
      T. Finnan affirms this criminal complaint against Andrew Cuomo of New York, NY on information and belief for receiving gifts(benefits) for his election campaign (gratuities) from lawyers with actions pending before NY State and defended by Andrew Cuomo in his official capacity when he was not entitled to any special or additional compensation in violation of NY Penal law § 200.35 Receiving unlawful gratuities.
Andrew Cuomo also received over $10,000 which he solicited and accepted in hope that his discretion as a public servant either as Attorney General or later as Governor would be influenced in violation of Penal law  § 200.11 Bribe receiving in the second degree.
    T. Finnan notes that Andrew Cuomo applied different laws for contributions in the NY Comptroller's Office than to contributions to himself, but T. Finnan knows by his personal examination of the NY Constitution and NY laws that the same laws apply to the Attorney General and that Attorney General Cuomo personally and willfully violated the same laws he enforced in the Comptroller's Office.   T. Finnan makes this affirmation under the penalties of perjury in the State of NY.

re: POST: Andrew Cuomo's Corruption Allowed $400 Million To Be Added to $1.2 Billion In NY Medicaid Fraud Which Must Be Refunded By NY State To Federal Government
and your potential liabilities

Dear Rating Agencies:
This is to make you aware of the moral, financial and corruption hazard that was and is Andrew Cuomo and the disasterous effects on NY Bond values. You may not be aware of the Medicaid returns liability facing NY State and the costs of these Medicaid  frauds to NY Counties.   My blog CuomoTARP.blogspot.com describes liabilities to NY State for the return of Medicaid funding of $1.6 Billion dollars.  If you look at the links on the blog, you'll access original federal documents.
Mr. Cuomo may be hoping to fool the people, but you do not want any liability imposed on you for ignoring these reported Medicaid liabilities that can be considered a small sample of a much larger problem when other NY Medicaid transactions will certainly be examined.
"A word to the wise suffices."
            Sincerely, T. Finnan, CuomoTARP.blogspot.com

Part 1 Andrew Cuomo's Corruption Allowed $400 Million To Be Added to $1.2 Billion In NY Medicaid Fraud Which Must Be Refunded By NY State To Federal Government

NOTICE: This exposes massive fraud and liability for NY State in only a small part sample of NY's Medicaid.
After this NOTICE, Standard & Poor’s, Fitch, and Moody’s will have a liability for cover-up, if they don't correct NY Bond ratings before the election.
Note that NY Medicaid isn't really benefiting its intended, i.e. "physical abuse or threats of physical abuse, theft, and beneficiary abandonment."
NY State will have to repay US Government from where?  Bankruptcy, service collapses
One man is responsible for this cover-up, this non-prosecution and $1.3 Trillion in federal losses and $5 Billion in NY State and NY County losses.

To Andrew Cuomo: no one, nor NY State can afford your profligate indifference to your costs generated by your toleration of corruption.   The latest 10/8/2010 Federal Inspector General report for 2004 to 2006 shows over $115 million is needed to be refunded by NY State to the Federal Government and if we conservatively multiply this for 2007 to 2010 by three, we have about $350 million to be refunded for this one item alone in this Inspector General Report.  And this isn't all, an earlier post showed $1.2 billion in Medcaid fraud reimbursement owed to Federal GovernmentAnd, worse, NY State and its counties have paid and lost a matching sum.   And from the post below, we know you, Andrew Cuomo, are a control freak.

Here's the Inspector General's condensed report:

Office of Inspector General, Washington, D.C. 20201

SUBJECT: Review of Medicaid Personal Care Services Claims Made by Providers in  New York State (A-02-08-01005)

Our audit period covered January 1, 2004, through December 31, 2006.

Pursuant to Title XIX of the Social Security Act, the Medicaid program provides medical assistance to low-income individuals and individuals with disabilities. The Federal and State Governments jointly fund and administer the Medicaid program. At the Federal level, the Centers for Medicare & Medicaid Services (CMS) administers the program. Each State administers its Medicaid program in accordance with a CMS-approved State plan. Although the State has considerable flexibility in designing and operating its Medicaid program, it must comply with applicable Federal requirements.

In New York State (the State), the Department of Health (DOH) administers the Medicaid program. Within DOH, the Office of Long Term Care oversees the personal care services program. Each county’s social services district is responsible for authorizing personal care services, arranging service delivery, and monitoring the personal care services program.

[Problems] include, but are not limited to, physical abuse or threats of physical abuse, theft, and beneficiary abandonment.

We recommend that the State: • refund $100,335,472 to the Federal Government;
• improve its monitoring of the personal care services program to ensure compliance with Federal and State requirements;
• work with CMS to resolve the eight CDPAP claims and, if applicable, refund the estimated $15,325,689 in unallowable payments;
(end of condensed letter)

It's reported that Andrew Cuomo was personally involved in everything in his office (likely, this was leaked by his underling "rats", who feared being blamed or prosecuted)  So Andrew knew of these frauds and chose to do nothing, except put his CuomoTARP over the corruption.
Andrew Cuomo's cost is astronomical.  Follow the links to just a few examples below on this blog.
See
Cuomo's heart of darkness and predatory lending
Cuomo as financial and corruption "moral hazard"
Cuomo missing in action; Peter or Dilbert principle or cover-up

We lost and Cuomo won?
Cuomo's silver spoon costs us over a trillion dollars
Cuomo changes pay to play to indirect payment and we're fooled
Cuomo and NY borrowing and his silver spoon
Cuomo makes his rich friends richer and the poor poorer

Andrew Cuomo has caused a lost minimum $1.3 Trillion federal dollars and a lost minimum $5 Billion NY State and NY County dollars.
First step: Lock him away from any control over NY Finances or any oversight function.
Second step:  New Governor orders new AG to prosecute and recover losses due to criminal fraud.

Control Freak Andrew Cuomo Rated "Best Buy" While NY Sheeple Fear Fleecing Or Worse

Warning: Fred Dicker (NY Post), the NY Times and the Times Union might advise the NY sheeple to avoid any unpleasant  thoughts which may arise from this post.

Has our "Shepherd to Be" already sold out to the wolf pack?

Andrew Cuomo is rated a "best buy" says the Financial Department at CuomoTARP.   We base this on the continued success of Andrew Farkas' investment in Cuomo, which began with  Here’s a man who stole millions of dollars, and Andrew gives him a pass,

And Cuomo following the advice that "nice guys finish last"  punished Farkas' enemy when, "Andrew Cuomo knows full well that his own inspector general recommended full and total prosecution of Andrew Farkas, yet Cuomo quashed the charges personally. Worse, he then moved to ruin IG Susan Gaffney's career because she didn't buy Andrew's gambit."

But the NY sheeple were earlier assured when, "Mr. Farkas said he understood why their relationship was viewed with suspicion. But he insisted his motives were pure, saying he was not seeking any personal gain."

Only the "control freak, Andrew Cuomo" knows whether Farkas benefited when "Everything that has transpired at HUD is not an accident, and it sure isn't a computer glitch. ...it is impossible to explain it as anything other than significant financial fraud. The losses could be far greater than $59 billion, but they don't know for sure because the audit isn't completed. Secretary Cuomo is a very smart control freak, so it's ludicrous to think that he doesn't know what is going on."

We've learned that Farkas profits, when others lose their shirts. In the financial collapse of Dubai World, Farkas invested in more than $2 billion of U.S. property deals.   But, "Despite Dubai World's problems, Mr. Farkas earned at least $70 million in advisory fees, according to people familiar with the matter. He also cashed out his ownership stakes early, netting tens of millions of dollars, according to these people."

Now, Farkas has invested $18 million dollars in Cuomo's election campaign.  Farkas must know he'll get a good deal out of Andrew Cuomo.

And other investors in Andrew's campaign, the rich lawyers, have assured us, ""We do not think that the attorney general of New York would make it any easier for lawyers or cut any slack for their clients because of the lawyers’ prior campaign contributions,”

Andrew, will Farkas profit while NY follows Dubai into financial collapse?  Are you and Farkas looking for a trifecta of winnings from three financial collapses?   And Andrew, what is the due that you, or Farkas or the other investors in your campaign will extract from the sheeple of NY?   A screwing, a fleecing or a glut of lamb chops on the market?

Andrew Cuomo Kisses And Makes Up With The Albany Swamp's Legislature Vermin, Reprobate Politicians, A Whore

Do you have what it takes to be with Andrew Cuomo's friends under the CuomoTARP Tent located in the Albany Swamp?
               WATCH OUT!
Is it Andrew, or one of his friends?
  The friends list:
Rep. Charles Rangel parties with Gov. Paterson, AG Andrew Cuomo at birthday bash

A friend that Spitzer had to pay for, but is free for Cuomo, Ashley Dupre  (Is soliciting allowed under the CuomoTARP Tent?)

Brooklyn Democratic boss Vito Lopez and his massive social-services empire faces two federal investigations into alleged improprieties.   But, Cuomo said  Lopez, "is my good friend;" "We do a lot of good work together." while seated across from Lopez during a gathering with Hasidic leaders in Williamsburg.    Lopez, who definitely needs Andrew's continued indulgence, is preparing to lead the chorus for "What a friend we have in Andrew" hymn on the left side of this blog.

The Slime Covered Swamp Vermin in the NY Legislature who Cuomo promised to clean out are now Cuomo's friends.  Cuomo said, “I don’t believe there’s going to be a confrontation. The Legislature doesn’t want trouble. They want good news from a P.R. point of view. They need redemption. They need a friend. Eliot could have been their best friend. I think I can be their best friend.

David Paterson, as friend? or as obedient house boy who knows where his goose could be cooked and won't upset the Cuomo apple cart?

Andrew Farkas, rehabilitated after, "Cuomo accused Farkas of paying millions in kickbacks to the owners of buildings that Insignia managed, and the company settled the case by paying a hefty fine. But the two apparently patched up their dispute: Cuomo later took a high-paying position with Insigna"

Allen Isaac, who hopefully learned why Audrey says, "There's no free lunch."  Along with all the other reprobates, crooks, and others exposed in this blog.

And on a high rock of honor ($18 million price), which he purchased, is Farkas, who profited from mortgage crisis here in NY and profited from his misdealings in United Arab Emirates.   "Thanks to Farkas, Cuomo’s current campaign war chest for governor is $18 million – big enough to eliminate primary competition before it starts. With a past already raising uncomfortable questions for Cuomo, Farkas is deeply embedded in controversial Middle East financial dealings, having created a “Fannie and Freddie for Dubai” in the United Arab Emirates. A quick wheeler-dealer, Farkas bailed out before the Emirate’s colossal credit crisis, and made a string of similarly well-timed deals with Dubai World in 2009, with whom he flipped marquee Manhattan properties."

Although the stench under the CuomoTARP tent should be extreme from the combined Albany swamp vermin, reprobate politicians, crooks and Spitzer's doll, high powered fans are in operation.   Do you expect Andrew to become "Lord Potentate of the Swamp"?  Do you want to be Andrew's friend under the Cuomo TARP tent?  You need to pay up and/or enhance your infamy portfolio.

Listen, the reprobates' chorus in the swamp is beginning,    (Complete Hymn is on left side of this blog)

What a friend we have in Andrew,
all our sins and crimes to bear!
What a relief to not worry with Andrew in the Attorney General chair!
O what peace we ought to forfeit,
O what pain and jail we ought bear,
but we are spared and protected with Andrew in the Attorney General chair.

This Week In NYC Federal Court, Andrew "Monkey Business" Cuomo Charged With Conflicts Of Interest And Impropriety

This week, Andrew Cuomo was charged with "CONFLICT OF INTEREST AND APPEARANCE OF IMPROPRIETY" in US DISTRICT COURT in New York City, before US District Judge, Shira Scheindlin.   But while Cuomo has been caught monkeying around, the NY Times, Daily News and Fred Dicker (NY Post), were diverted from reporting the corruption by enjoying the views at the Gay Pride parade of Cuomo marching with his daughters.  When Cuomo corruption is involved, these media monkeys pervert the message of the three Japanese monkeys, by their see no evil in Cuomo's monkey business, report no evil with Cuomo's monkey business,  cover-up the evil of Cuomo's monkey business.

The Federal action filed  this week complains, "the AG not only advises the Executive branch of State government, but also defends actions and proceedings on behalf of the State   As it relates to the instant Motion a multiplicity of complaints filed with the AG, and through several administrations, requesting that the AG should criminally prosecute such lawyers, law firms, and public officers, for harming the “People” (in this case Plaintiffs who seek the fruits of their labor to create the Inventions), instead the AG turns around and represents these same individuals complained of. Accordingly, this Court, however, must now disqualify the AG from any representation of the State Defendants in their official and individual capacities as a result of these conflicts of interests and appearances of impropriety".
The action involves RICO charges and a "Pattern of Racketeering" connected to Cuomo.

The media monkeys have assisted in helping Cuomo pull the Cuomo TARP over himself.   Gay Pride is a flea on the back of one of the pack of bloated NY government monkeys stealing from the taxpayers and stealing from the People in a corrupt court system.  All covered up by Attorney General Andrew "Monkey Business" Cuomo and his trained media monkeys.

Hypocrisy Isn't Possible, If Thy Name Is Andrew Cuomo

      "Hypocrisy, thy name is Andrew."
Andrew Cuomo's very busy just as he's leaving office and is seeking to end pay to play.

The law firm Manatt Phelps & Phillips agreed to a five-year ban from appearing before public pension funds in New York State.
Here's Cuomo's agreement with Manatt, Phelps & Phillips about accepting money required for the NY Comptroller's Office

Excerpt from above agreement:   WHEREAS:  the Attorney General finds that persons and entities doing business before the State Comptroller's Office are frequently solicited for and in fact make political contributions to the Comptroller's Office before, during, and after they seek and obtain business from the Comptroller's Office
WHEREAS, The Attorney General is the legal adviser of the Common Retirement Fund

Manatt agreed to comply with the Attorney General’s Public Pension Fund Reform Code of Conduct, which, among other things, bans the use of placement agents to solicit investments from public pension funds and prohibits investments within two years of any campaign contribution from the investment firm to the Comptroller or other elected trustee.

It all sounds wonderful until you realize, Cuomo's rules for the NY Comptroller's Office don't apply to the Retirement Fund's legal adviser, Cuomo, nor to Cuomo's Attorney General's Office.  No need to wait two years or two minutes to contribute (to pay up), Andrew has his own rules for the Attorney General's office on his donation forms, where "contributors [are asked] to sign a statement saying they have no “matter” pending with him. That rule “does not extend to attorneys representing persons or entities with matters before the NYS Attorney General’s office.

Did Manatt, Phelps & Phillips fail to first give to Andrew's campaign fund, since he was the retirement fund's legal advisor?   Maybe, they would have obtained a indulgence from Andrew and avoided all these problems.    Maybe they didn't read the earlier blog post here: "Two faces as Cuomo changes pay to play to indirect payment"

Hypocrisy doesn't apply Andrew, who follows the Special Rules for Anointed Legacy Governors in waiting.

"Pretty Boys," Cuomo and Tembeckjian, Are The Smiling Facade On NY Corruption

There were NY Senate Hearings into corruption in the NY Courts and in the Attorney Grievance Committees of Appellate Courts and in the NY Commission on Judicial Conduct.  I testified at those hearings which were recorded in three very long videos:
9/24/2009
http://www.youtube.com/nysenateuncut#p/u/0/knQLll5hmjs
6/8/2009 part one
http://www.youtube.com/watch?v=HR8OX8uuAbw
6/8/2009 part two
http://www.youtube.com/watch?v=28afajRkDwY
Here above is "Pretty Boy" Robert Tembeckjian of NY Commission on Judicial Conduct, all primed, at above hearings.

At the above hearings, in order to be heard concisely, I promised to shorten my presentation to less than 5 minutes using only the most deplorable criminal conduct of Judge Kevin K. Ryan, Mr. Tembeckjian and the NY Commission on Judicial Conduct members.   My less than 5 minute presentation follows:

My above mentioned letter to Mr. Tembeckjian and to each member of the NY Commission on Judicial Conduct was individually sent to each by certified mail.  There was no excuse, other than dementia, for Mr. Tembeckjian or the other members of the Commission to not know that such trial conduct was illegal and wilful misconduct under the NY Constitution's § 6. ...The power of grand juries to inquire into the wilful misconduct in office of public officers, and to find indictments or to direct the filing of informations in connection with such inquiries, shall never be suspended or impaired by law. No person shall be deprived of life, liberty or property without due process of law.

The wilful misconduct was not only by Judge Kevin K. Ryan, but by Mr. Tembeckjian and each member of the NY Commission on Judicial Conduct.  And as per above Constitutional clause, Andrew Cuomo could have had a grand jury indict or file an informations against Mr. Tembeckjian and all members of the Commission. (In NY as per above Constitutional clause, there is no immunity for anyone because  "such inquiries, shall never be suspended or impaired by law.")

I filed with Andrew Cuomo a sworn criminal complaint concerning the wilful failure of Mr. Tembeckjian and each member of the Commission to carry out their duties as imposed upon them in their oath of office and clearly inherent in the nature of their offices for violation of Penal Law § 195.00 Official misconduct. A public servant is guilty of official misconduct when, with intent to obtain a benefit or deprive another person of a benefit: ... 2. He knowingly refrains from performing a duty which is imposed upon him by law or is clearly inherent in the nature of his office.

Andrew Cuomo, you also failed to do your duties, as clearly inherent in the nature of your office.    The People of NY want the corrupt in jail.

See their smiling faces; see their styled hair; ignore their filthy hands.  "Pretty Boys," Robert Tembeckjian and Andrew Cuomo, are the smiling facade of NY corruption.

Andrew Cuomo Covers-up More Of Robert Tembeckjian's Crimes at NY Commisssion On Judicial Conduct

The text of Certain NY penal laws: § 20.00 Criminal liability for conduct of another. When one person engages in conduct which constitutes an offense, another person is criminally liable for such conduct when, ... he solicits, requests, commands, importunes, or intentionally aids such person to engage in such conduct.
§ 195.00 Official misconduct. A public servant is guilty of official misconduct when, with intent to obtain a benefit or deprive another person of a benefit: ... 2. He knowingly refrains from performing a duty which is imposed upon him by law or is clearly inherent in the nature of his office.

Andrew Cuomo and his NY AG Public Integrity Unit were fully aware and knowingly covered up the crimes of Robert Tembeckjian, administrator attorney, for the NY Commission on Judicial Conduct.  A list of crimes follows with links:  (Friedberg is former lackey deputy to Tembeckjian)

 4. Tembeckjian's Crimes, Part 4 (Cavorting with Felons)

Tembeckjian and Friedberg Hit New Low
Tembeckjian and Friedberg's kind of New York judge parties with convicted felons, gives weekend jail time to a 'favored' lawyer's client who killed a man while driving drunk and who remarked during the statutory rape case of a 14-year-old that the adult man having sex with the minor "...would not be unusual in their culture.”

5. Tembeckjian's Crimes, Part 5 (Albany Atrocity)

So, while a Federal Judge upholds criminal charges against a former New York State Supreme Court Judge, Thomas Spargo, and while a federal prosecutor with the U.S. Department of Justice, Public Integrity Unit, calls Albany Surrogate Judge Cathryn M. Doyle a "co-conspirator" in the involved criminal allegations, Tembeckjian and Friedberg appear to have done what they do best: cover-up, whitewash, ignore the outrageous crimes of some judges while nit-picking minor issues. One thing's for sure, Tembeckjian and Friedberg have trampled on a most basic right: due process. and do what they do best: cover-up and whitewash.

6.Tembeckjian's Crimes, Part 6 (Judicial Loan and Court Job)

Tembeckjian and Friedberg's useless dirty hands are all over the Brooklyn judge, Lila Gold, who still, according to OCA records, acts in judgment over others.

The New York Daily News By NANCIE L. KATZ - February 12, 2008

7. Tembeckjian's Crimes, Part 7 (Covering 3 Judges 9/11 Donation Fraud)

Tembeckjian and Friedberg whitewashed the criminal acts of 3 Judges who covered-up a politically active attorney's 9/11 Donation Fraud where over $120,000.00 in 9/11 donation cash was stolen, an insurance company was defrauded and a death occurred.

Tembeckjian and Friedberg also ignored another  complaint where Surrogate Scarpino confronted the pro se litigant in the lobby of the courthouse to express his anger: "I don't like the fact that you asked me to recuse myself" and "I wasn't the judge when your brother killed himself" and "So where do we go from here?"

And besides protecting criminals, what else does Tembeckjian do?   Does leaving a slime trail make you a slug?

Protecting Sheldon Silver - Tembeckjian's Latest Goon Squad Stunt

SHEL JUDGE AND PANEL 'SLUG' IT OUT
The New York Post by DAN MANGAN - July 28, 2009

An upstate judge is in hot water for calling Assembly Speaker Sheldon Silver a "slug" in The Post's pages. The state Commission on Judicial Conduct last week hauled Cattaraugus County Judge Larry Himelein, 60, before a referee on undisclosed charges. Himelein admits he used the epithet to describe the Lower East Side Democrat over long-stalled pay raises for New York judges -- but insists he did so in a leaked e-mail to fellow judges, not in an April 2008 phone interview with The Post in which he confirmed he was refusing to hear cases involving Weitz & Luxenberg, Silver's employer. The commission is also probing whether he said, "I think the speaker is a slug." Subpoenaed Post reporter Bruce Golding testified his report was accurate. A lawyer not involved in the case said Himelein was likely to get just a private warning if convicted of detracting "from the dignity of judicial office." But if found to have misled the panel, he faces tougher sanctions, including possible removal, the source said.

Is Andrew incompetent, or a clever cheat scheming to enrich himself and pals,  or a spoiled brat who's been taught that he's owed something, or Gollum obsessed with the "ring"?     It doesn't matter, he needs to be stopped.

Luckily, an alternate opportunity opened up with Spitzer's low ratings and desperate need of a stylist.
Spitzer's madam reports, "That is sort of synonymous of what the girls told me about him in bed, that he was boring, so I guess the expectations were met." and "I read that they were investing all this money in a stylist and I thought no matter what money you throw at this man, at the end of the day, he's still a gremlin and a dishonest, corrupt career politician whose only interest is rehabilitating his own image enough to get back into politics."

You, Andrew, although you are a corrupt, dishonest career politician, you're a handsome gremlin and not much money needs be spent on a stylist.   You didn't cheat on your wife, she cheated on you and, hopefully, she won't report you were a dud in bed.   You're an ideal Spitzer's replacement and your ratings can only exceed Spitzer's dismal ratings.
